EKA OPERATION RULES (will be in force from the 12/12/2013)
The EKA is the legal branch of the UAE SARF.
The EKA is the sole Authority regulating all activities regarding Kiteboarding in the United Arab Emirates.
Any activities related to Kiteboarding including Training, Rentals, Events, Clinics and Exhibitions can’t be held in the UAE without the approval of the EKA.
UAE LAWS APPLIES AT ALL TIME. THE EKA LAWS ARE BASED ON THE UAE LAWS.
1. EKA stands for Emirates Kiteboarding Association.
2. Operators stands for clubs, schools, and Instructors.
3. When "RECOMMENDED" is used, this stands for Advise.
4. When "SHOULD" is used, this stands for an Obligation.
5. When "SHALL" is used, this stands for a Formal Incoming Obligation.
6.0 When "WILL" is used, this stands for Can be expected to happen.
7.0 When "MUST" is used, this stands for an Obligation.
8.0 When "MAY" is used, this stands for a Possibility.
3.0.1 The EKA will ensure that the level of safety is clearly defined to the Kiteboard operators and Riders.
3.0.2 The EKA will not be held accountable if unruly operators or riders are deliberately breaching the laws.
3.0.3 The EKA will enforce the Rules & Regulations through its Compliancy Department.
3.0.6 The Chairman has always the last Decision in case of conflict.
3.0.7 The Chairman is the authority, which can nominates a person to hold multiple positions within the organizations for the safe conduct and/or to optimize the general performance of the organizations. This authority can be delegated to the Acting Chairman when it is necessary to do so.
3.0.8 The Acting Chairman is responsible for the safe conduct of the EKA and representing the Chairman. The Acting Chairman will take all necessary legal steps to safeguard the well being of the organizations.
3.0.9 The Chairman and the Acting Chairman are solely authorized to remove or nominate any person within the EKA organizations.
3.0.10 The President of the EKA is responsible for the safe conduct of all activities, the law implementation and the general performance of the organization. He must be alerted to the feedbacks of the EKA's lower structure and the community.
3.0.11 The President has full authority to take all adequate decisions and steps to improve the functionality of the EKA and its daily performance without infringing on the safety level of the organization.
3.012 The President has full authority to remove or suspend any one who is not complying within the organization’s structure or if an investigation by the Compliancy Department is in force.
3.0.13 The President shall facilitate the help of the EKA to the citizens and residents of the UAE within limit of feasibility.
3.0.14 The President has the authority to clear the Compliancy Department to open investigation, act or pursue any operator or person who intentionally breaches the law or the Safety Standard.
3.0.15 Heads Of Departments are responsible for the safety of their operations, law implementation, operators proficiencies, updating the community, stopping illegal activities, improving the yearly departments performances and organization, events and media communications and risk assessment or identify any risk for the EKA. Heads of departments are also responsible for alerting the top management when deemed so.
4.0 Regulations. 4.0.0 Swimmers have priority at any time even thought when they are swimming by mistake in a zone only defined for kite surf. TRAINING & LICENSING Regulation: 4.0.1 All riders and clubs should apply the Polyvalent Standard Beach Areas on any beach in the country when there is no a Special publishing for the concerned area.
4.0.2 All beginners under instructions should wear at all time : Helmet, shoes and Life Jacket. UNTIL RELEASED BY THE INSTRUCTOR.
22.214.171.124 All new beginners joining the training system delivered by the EKA Training Department and instructed by an EKA licensed Instructor shall be registered by their Instructor on the EKA website in the Training Page.
4.0.3 All instructions shall be conducted by a qualified instructors approved the EKA.
4.0.4 All instructions shall be conducted in the water ONLY when using an inflatable kite Foil bigger than 3m. And in the Training area.
4.0.5 When the Training area is in use for training purpose, any other riders shall not enter the Training Area to ride.
126.96.36.199 All qualified kite instructors, resident in the UAE and intending to teach kite surf shall obtain the EKA Instructor license by following a full training course or converting their foreign license if recognized by the EKA.
188.8.131.52 NON RESIDENT ARE NOT ALLOWED to use their privilege of kitesurfing instructor on the UAE territory.ONLY EKA licensed instructors are allowed to teach at the condition they full fill all the requirements of the UAE LAW to act and to operate commercially.
4.0.7 Riders holding a kite surf license not delivered by the EKA and resident in the UAE, shall obtain the EKA Safety Certificate. And if holding a foreign license as a tourist, the rider shall convert his license to the EKA Safety Certificate one month after his date of arrival in the UAE..
4.0.8 In the UAE it is not allowed to self teach kiteboarding. All new beginners SHALL go through training with an approved EKA Instructor.
184.108.40.206 ALL UAE RESIDENT KITESURFERS SHALL GO THROUGH a simple training of self rescue program. It is mandatory to all Instructor to go through an intensive Safety & Rescue training program.

4.0.9 All Instructor shall be pro-active toward safety. EKA approved instructors can use their privilege as an Instructor to intervene if in their judgment there are safety issues created by other riders. This Shall be reported immediately to the EKA.
4.0.10 The EKA will deliver a limited amount of Instructor licenses based on a pro-rata for the UAE. Every Emirate will have a quota of instructors. This is to protect the system in term of safety and legality.
126.96.36.199 The EKA retains the right to revoke any license at its own discretion without any further notice, or it has been miss leaded, or breaching any rules or by order of the EKA Head of training or the EKA President.
188.8.131.52 Instructors have authority to warn formally any one who is not complying the legislation and safety.
184.108.40.206 Examiners have the authority to revoke a license from an unruly operator or rider on the spot.
4.0.11 INSTRUCTORS shall not leave their trainee to launch and land the kite by themselves if deemed that the trainee is not proficient controlling the kite without assistance. It is the Instructor responsibility to insure that the trainee is aware about the kite landing and launching maneuvers and its safety aspects.
4.0.12 Any kiteboarding training not approved by the EKA is illegal.
Legal actions will be taken against offenders who are teaching or renting Kiteboarding equipments without the proper commercial documents and the approvals of the EKA.
All Operators who are intending to operate a profitable business by teaching/renting kites/Clinics/Safari must posses the EKA CERTIFICATE OF OPERATION see chapter 6 and 7.
4.0.13 No one is allowed to hold any kind of Kitesurf event (race, clinic, exhibition etc.) throughout the UAE unless holding the EKA CERTIFICATE OF OPERATION and the EKA EVENT CLEARANCE. Any one intending to hold any kind of events related to the kiteboarding shall get the permission from the EKA in written.
4.0.14 Riders are advised to check the weather and tides before heading out in the water. It is the responsibility of the rider to be aware about any weather changes which will affect its own safety.
4.0.15 Any kind of riding during stormy weather must be considered Dangerous and shall NOT be used for riding due to the unsafe weather conditions related to the stormy weather .
4.0.16 Any kind of riding during a hurricane, cyclone or any weather phenomena which is evidently put at risk its own life or others are not ALLOWED.
4.0.17 Stay safe and kite with a mate. It is not ALLOWED to ride alone due to safety considerations
7.0.0 Events and Competitions No operators, organizations or individuals are allowed to hold any SUP/SURF/KITE event in the UAE unless all the safety requirements are met and a formal approval is delivered by the EKA. When an event/competition is taking place on a private beach (on land ONLY) the organizers are waived to obtain an approval from the Government, except for the public beach where the event must be under the name of the EKA. NO PRIVATE/COMMERCIAL EVENT WILL BE AUTHORIZED unless it is an EKA event.
7.0.1 Sea, lakes and water are the property of the UAE government, falling under the navigational laws and municipality authority. Any SUP/SURF/KITE event in the UAE water's must be approved and authorized by the EKA, Sports Council and Municipality. No private event will be authorized on the UAE Waters unless it is an EKA event. Some Exceptions can be granted when the private beach are under a specific governmental approvals, unless otherwise restricted.
3.0.17 Heads of Departments are responsible to liaise with the Compliancy department when deemed to do so.
3.018 Head Of Department will insure that the Emirates Representatives are fully complying with the rules and regulations of the EKA.
3.0.19 The Water & Beaches Safety department will ensure that the safety and the regulations of the EKA are applied accordingly to the department rules.
3.0.20 The Water & Beaches Safety department will always define a Safety Standard structure for all the UAE water & beaches. In case the Safety Standard Structure is not adequate for a specific beach due to the terrain or the water, then a Special Safety Structure should be published and after a short period of trial (6 months) a review and decision should be made.
3.0.21 All departments and organizations should comply with the Water & Beaches Safety Department.
3.0.22 The Compliancy Department is responsible for the safeguard and integrity of all organizations on the water and the beaches.
3.0.23 The Compliancy Department consists of 3 Emiratis. They are qualified as Inspectors. The Inspectors shall be from the law enforcement industry.
3.0.24 On the beaches or if informed of illegal activities, the Inspectors have the authority to spot check anyone deemed necessary and take all necessary actions to stop all illegal or unsafe activities through the entire UAE. Police, Municipalities, Coast Guards or any other government body approved by the EKA have the same right as the inspectors. Police have the last say.
3.0.25 Legal Action Procedure:
3.0.26 Any infraction by a rider, Instructor or Kite School will lead to action taken by the committee against the offender or offenders.
3.0.30 The Compliancy Department is the sister department of the Water & Beaches Safety Department.
3.0.31 ALL ACTIONS RESULTING IN FINES, WILL AUTOMATICALLY BE FOLLOWED BY A COURT CASE.
3.0.32 The Emirate’s Representative is the voice of its Emirate’s community within the Technical Committee (TECHCOM). His/Her responsibility is to canalize, prioritize request, proposals and concerns, direct/solves issues or requests or submit them to the higher level or to the TECHCOM.
3.0.33 The Representatives are the direct line of communication with the EKA's higher levels. The Community should not contact higher levels of the EKA unless there is a serious concern or the issue has not been resolved through the representatives after a reasonable amount of time (to be determined by the EKA executive committee.
3.0.34 The proper channels of communications are: The Emirate’s Representative -- Head Of the Department --- President --- Executive Advisor --- UAE SARF COORDINATOR --- Acting Chairman --- Chairman.
3.0.35 The Emirate’s Representative is responsible before the EKA of maintaining the safety level and make sure the laws are followed. He is authorized to suspend any operator of its Emirate not following the rules or breaching the safety regulations. He is authorized to inform the Compliancy Department of illegal operations.
3.0.36 The Emirate’s Representative has the authority to revoke a Rider Safety license of any unruly rider if deemed necessary for the safety of the community. And must advise the Water & Beaches Safety Department, which will take the appropriate action against the offender.
3.0.37 In case of a serious breach of the safety due to misbehaviors, The Emirate’s Representative shall call immediately the police and the Compliancy Department. At this stage the Compliancy Department will take over and proceed with the legal actions on a later stage.
3.0.38 The Emirate’s Representative is representing its Emirate within the TECHCOM for all matters concerned by the community and the final votes to pass a law.
3.0.39 The Emirate’s Representative shall always keep a good relationship with its community and facilitate the life of the community as feasible as possible. But at the same time He/She should not compromises at the expense of the safety.
4a.0 Water & Beach Safety (WBS).
The WSB is the ruling safety body within the UAESSA & EKA.
4a.0.0 Safety & Regulation are the sole duty of the WBB.
4a.0.1 The prerogative of the WBS is to develop, test and enforce all the necessary requirements to keep the safety standard high.
4a.0.2 The WBS will periodically issue information about the safety within the SUP/SURF/KITE community in the UAE.
5.0 IKA/EKA Standard & Training:
5.1 All Operators must follow The Operator Standard & Training syllabus provided by the EKA.
5.2 The Operator Standard & Training syllabus is the EKA standardization program fo schools, and Instructors.
5.2.1 All operators will have to go under a special Safety & Rescue program before moving to the requirements of chapters 6 & 7.
5.3 ALL riders who are UAE or GCC resident must go through the EKA Standard & Training program, have passed successfully the Safety and Rescue program for the riders. This is done to standardize every one knowledge.
5.4 After successfully passing all the requirements of 5.2, 5.2.1 and 5.3. A Safety Card will be issued to the Operators and Riders. This card must be renewed every 24 month before closing the 25th month of calendar. The card will authorize the riders to participate to any IKA international competition.
5.4.1 Qualified Eka Instructors fully employed by a private or a government company and intending to use their EKA Instructor privileges SHALL present by written a NON OBJECTION LETTER delivered by their sponsor, this is a requirement from the Labour Law.
5.6 The Operator Standard & Training syllabus for Operator and Rider is TBN.
5.7 The EKA does not recognize any of the international private federations or their licenses. EKA is a Governmental body, NOT PROFITABLE, NOT POLITICAL and not a private company.
5.8 Foreign qualified Instructors not holding an IKA/EKA license are not authorized to teach Kitesurf on the Emirati territory. They must comply with UAE labor laws.
5.8 Foreign qualified instructor, intending to practice any activity related to the EKA must hold an EKA INSTRUCTOR LICENSE and be UAE RESIDENT.
5.8.1 Never the less an Instructor must be part of a registered school approved by the EKA.
5.8.2 Individual Freelance EKA Instructors are not allowed in the UAE.
5.8.3 Foreign Licensed Instructors intending to have any kind of activity related to the KITESURF in the UAE, SHALL attend a Conversion and Standardization course, Safety & Rescue Program and a final check with an EKA Examiner.
5.8.4 The EKA will maintain an adequate quota of EKA's Instructors and Examiners through the UAE.
220.127.116.11 New EKA Instructors can only apply for positions when the EKA is advertising for Instructor Positions.
5.8.5 Any one intending to become an EKA Instructor must meet the minimum Requirements based on the IKA standard, the below requirements will be amended:
A) 21 year old or above and UAE resident.
B) 3 years of experience as Kitesurfer
C) Good English.
D) Safety Card Level EKA Instructor.
E) EKA Safety Card never suspended.
F) Advanced Safety & Rescue Test.
G) Recommended by his/her Emirate Representative.
H) Final Check with an EKA Examiner.
The EKA retains the right to refuse any candidate without further explanations.
6.0 Operator & Rental Equipment Requirements
No operator is allowed to operate on any Beaches or Water through the UAE based on a profitable business unless possessing a Valid trading license delivered by its respective Emirate Chamber of Commerce ( FREE ZONE TRADING LICENSE IS NOT ACCEPTED) with the adequate annotations of the intended business on the trading license. Must obtain the teaching license from the Ministry of Education, Youth & Development with the intend sport or sports to be teach. Must have an Insurance covering all aspects of the liabilities for the intended operation. After processing all the required papers the operator may apply to the EKA for final review. The final approval is a matter of decisions between Sports Councils and the EKA. If approved by the EKA & Sports Councils, the Sports Council will process all authorizations with the municipalities and concerned governmental bodies to deliver the final clearance to operate.
6.1.0 The trading license must contain the proper annotations for water sport and/or rental.
6.1.1 The Trading license must be valid and must specify its operational range within the UAE or only to its respective Emirate.
6.1.2 No operator will be allowed to operate on any kind of profitable business unless processing the appropriate insurance and liability to covers the entire operation.
18.104.22.168 No operator will be allowed to operate any kind of profitable business unless processing the Sports Council Written Authorizations through the EKA.
22.214.171.124 No operator will be allowed to operate any kind of profitable business unless processing the EKA Certificate of Operation and complying with paragraphs 6.1.0 to 126.96.36.199.
6.1.3 Rental Authorization can only be delivered to hotels, operators and not to individuals or individual EKA Instructors.
6.1.4 To obtain a EKA Operating Certificate, the operator must have a qualified EKA Trainer approved by the EKA and submit its contingency procedure for kites schooling/rentals (Checking the level of the rider, safety procedure) and have obtained the EKA Operator Safety Card for Operators.
6.1.5 The operator must meet the Water & Beach Safety requirements and Obtain The Operator Safety Card.
6.1.6 The operators must obtain and comply with EKA Operator Standard & Training.
6.1.7 All operator shall handover their Operation Manual after having completed 6.1.5 to 6.1.6. The operation Manual should contains the following Chapters: -Responsibilities & Liabilities -Training & Standard procedures -Equipment check procedures -Safety & Standard procedures
